1. Platform Purpose & Intermediary Status
NyayKutumb (न्याय कुटुंब) operates as a neutral, crowdsourced civic telemetry and public interest whistleblower platform. Under Section 79 of the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, NyayKutumb acts as an intermediary providing automated submission, PII sanitization, and legal drafting tools.
2. Whistleblower Guidelines & Defamation Shield
To protect whistleblowers, citizens, and public servants alike, all submissions on NyayKutumb are governed by strict public-interest disclosure guidelines:
Citizens MUST submit reports referencing the official administrative Role or Designation (e.g., "Junior Engineer", "Patwari", "Sub-Registrar Clerk", "Beat Constable") rather than an individual's personal name. Reports containing personal names, private home addresses, phone numbers, or bank accounts are subject to automated PII redaction or moderation.
Statutory Defamation Exception: Under Exception 1 & Exception 2 to Section 356 of the Bharatiya Nyaya Sanhita, 2023 (formerly IPC Section 499), imputations made in good faith respecting the conduct of a public servant in the discharge of public functions, or respecting any character for the public good, do not constitute criminal defamation.
3. Acceptable Use Policy (Prohibited Submissions)
Users agree NOT to use NyayKutumb for:
- Filing intentionally false, fabricated, or extortionate complaints against any individual or department.
- Publishing Personally Identifiable Information (PII) including phone numbers, personal email addresses, home addresses, or bank details.
- Posting obscene, defamatory, hate speech, or sexually explicit content.
- Attempting to bypass client-side EXIF scrubbing or reverse-engineer anonymous submission hashes.
4. Limitation of Liability & Moderation Rights
NyayKutumb reserves the right, but assumes no obligation, to review, edit PII, redact personal identifiers, or hide user submissions that violate these Terms of Service. NyayKutumb shall not be liable for any direct, indirect, incidental, or consequential damages resulting from user reliance on crowdsourced data or statutory draft templates.
5. Open Data License
All aggregated civic telemetry, state/city stats, and open dataset dumps are licensed under the Open Data Commons Open Database License (ODbL). You are free to share, copy, adapt, and analyze the data for public interest research, journalism, and advocacy provided appropriate attribution is given to NyayKutumb.
